[FL] Gainesville Data Cap and terminating under PLG?

I ended up being in that 1% that Cox targeted for exceeding the data cap. I work from home, so I'm a fairly heavy user and the rest of the family streams all day. I was at 1.2TB last cycle and on track for 1.2TB this month as well. I called and have an appointment setup to switch to Business class service, but since I'm not keeping the TV package they're insisting I pay the PLG termination fee and that the data cap "surcharge" is not covered as a material change under section 3.5 of the agreement. Loyalty did offer to waive the fee if I kept the TV service, but the cost of TV only was $10 less than my bundle. That is a pretty steep cost increase to establish a cannot-exceed cost service like I had before. It's bad enough I can't use the remaining TVs in the house since they axed analog this summer and only comped one minibox. Did anyone find a better approach to Cox that didn't result result in having to pay a huge increase or talk them out of the fee? I don't even know if I have a valid complaint with the way the PLG agreement is written.
